Please read these terms and conditions which govern the use of this website (including any sub-domains, unless expressly excluded by their own terms and conditions).

Your access to and use of this Service is conditioned on your acceptance of and compliance with these Terms. These Terms shall apply to all visitors, users and others who access or use the Service. 

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

DEFINITIONS

“Content” means any content, writing, images, or other information published on this Service.

“Terms” means these terms and conditions.

“Service” means the website including all pages, subpages, blogs, forums, and other connected internet content whatsoever.

“Student’’ means both students and users of the Service.

“Products” means the goods and products (tangible and intangible) offered on the website.

AGREEMENT

By using this website, you acknowledge that you have reviewed, considered the Terms of this Agreement, and understand same and agree to be bound by it. If you do not agree with these Terms or do not intend to be bound by it, you must cease the use of this website immediately. Furthermore, you shall be subject to all guidelines that are applicable to such services. Please note that any participation in this Service shall constitute your acceptance of this Agreement. 

By using this website and agreeing to the Terms herein contained, you represent and warrant that you have the legal capacity to accept these Terms. 

ABOUT US

PODTech Network CIC (hereinafter referred to as PODTech) offers a contract-free Student and Web Hosting Service (hereinafter referred to as Student+) which may be purchased either annually or monthly. 

Where you opt to purchase an eligible course, users will be redirected to a Thank You page where they may choose to signup for a Student+ plan. Free hosting may be included in a course purchase. Please visit the individual course page for more information on this. 

Student+ plans are optional and are not required to complete the course. Other Third-party hosts may also be used for clients who wish to participate in PODTech’s courses. 

PAYMENT AND BILLING

All payments are made through a third-party provider: GoCardless.

If you access the access the Service or purchase any Products, you agree to pay the full price as at the time of purchase.

The total price shall include all applicable taxes as at the time of purchase.

The available payment options automatically renew either on an annual or monthly basis. You may cancel at any time up to seven days before the renewal of the plan. 

All cancellations shall be subject to your bank’s direct debit policy.

REQUIREMENTS AND RENEWALS

Student+ hosting plan renewals shall be made regardless of course completion unless cancelled following the correct procedure.

Students may purchase one Student+ hosting plan per enrolled course.

Students may only have one website per Student+ hosting plan.

Students may manage multiple Student+ hosting plans for multiple enrolled courses.

Students may also purchase additional Student+ hosting plans without purchasing a course. This can be done by contacting hello@podtech.org or via the web hosting page here https://podtech.org/student

Where a one month free Student+ hosting plan is applicable, free hosting is limited to one per person, with exception to cases where additional courses have been purchased. If you have already received a one month free web hosting and not purchased any other course, you shall only be eligible for free web hosting again at the sole discretion of PODTech.

Student+ prices are stated on https://podtech.org/student and PODTech reserves the right to amend hosting prices up to seven days before the renewal of the next payment cycle. Notice shall be served to the email address used for signup. PODTech shall not be held accountable for emails not checked within this time. The client reserves the right to appeal this increase within thirty days from the notice email.

THIRD PARTY HOSTS AND LINKS TO OTHER WEBSITES

PODTech’s Services may contain links to third-party websites or Services that are not owned or controlled by PODTech. PODTech has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that PODTech shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or Services available on or through any such websites or Services. 

PODTech undertakes to provide accurate information at all times. Notwithstanding, PODTech does not guarantee the reliability of any information relating to the Services provided by third-party websites.

Please note that PODTech courses may not include a Student+ hosting plan and a Student+ hosting plan may be required to be purchased in addition to a course

DOMAIN

Student+ hosting plans come with one free temporary domain per hosting plan. This is optional and must be requested by the student. Temporary domains shall appear as shown below and only the number will change:

Clients cannot have their own unique temporary domain and a subdomain on the Student+ hosting plan. Your plan only has availability for one domain or subdomain. Please note that temporary domains may differ from the example given above. 

PODTech may advise on domain purchases and how to connect these domains to your Student+ hosting plan. Please note that charges may apply.

TROUBLESHOOTING, FIXES AND REPAIRS

Student+ hosting plans are managed by PODTech. All correspondence regarding hosting issues must be made through the hosting plan manager at hello@podtech.org.

PODTech shall not be held responsible for loss of functionality, damages, data breach or malware of any kind in relation to your website and/or hosting services taken. For your security and to protect your personal data, please note that PODTech will not request access to any third party domain provider accounts which you may have.

Student+ hosting plans do not include any maintenance of the website. If your website needs fixing, we would seek to connect you to an approved third party vendor such as Pink Orange Designs who may assist with resolving the site’s issue. However, Pink Orange Designs is under no obligation to repair your website. Website repairs may be chargeable. This may be taken out as a one-off or as a monthly retainer.

Repairs to the site which fall outside of Pink Orange Designs’ expertise may be referred to third-party developers.

PODTech and Pink Orange Designs are under no obligation to cover the costs of these fixes.

SUBSIDY APPLICATION

Clients on the PODTech Subsidy programme shall have a subsidised rate for the first year which shall be reviewed on a yearly basis and such subsequent renewals may be increased to match the Student+ programme.

Clients may at any time provide evidence of low income by uploading their most recent payment statement from Universal Credit. Clients may block out their finances, but their full name and address must appear on the document as well as any named parties and transactions. Any documentation shall only be used to verify their income support status, no copies will be made, and the document shall be immediately deleted.

CANCELLATION 

PODTech reserves the right to cancel any Student+ hosting plan without cause. PODTech must provide seven days’ notice before cancelling any plan and this plan shall terminate at the end of that respective payment cycle. Any breach of PODTech’s terms and conditions may result in immediate cancellation of your hosting plan which may result in loss of website data.

If PODTech hasn’t received any correspondence from a client within the seven-day notice period or is unable to reach a solution on payment the Student+ hosting plan will be cancelled and the data will be removed from the server. This may result in the loss of website data.

Once the data has been removed from the server, the data may be retrievable for up to thirty days. A third party contractor may be brought in to complete the work and charges to reinstate the data may apply. Any additional costs incurred to retrieve the website data must be paid in full prior to the work being done. PODTech cannot guarantee that data shall be retrievable within this thirty-day period. 

Cancellations to your plan must be made in writing to: hello@podtech.org. Failure to do so may result in your next payment cycle being due or a twenty pounds administrative fee being applied. 

If temporary domains are being used for web builds, these domains will need to be included in the cancellation email.

Your first month renewal can only be cancelled seven days before the next payment is due.

Any payments that are debited because of not following the cancellation process may not be refunded and/or an admin charge of twenty pounds may be applied. Please note that an admin charge of twenty pounds may also be applied for any other late payments or where your account needs to be terminated for any other reasons outside of and contrary to the terms of the agreement.

INTELLECTUAL PROPERTY OWNERSHIP

PODTech shall retain ownership of all Content whatsoever included on the website other than content uploaded by users.

You are granted a limited license only, subject to the terms contained herein. Nothing on this website shall be construed as granting any license or right to use any intellectual property displayed on the website without obtaining the prior written consent of PODTech.

You shall not reproduce or distribute PODTech’s intellectual property or use its intellectual property for any unlawful purpose.

ELECTRONIC COMMUNICATIONS

You consent to receiving electronic communications and you agree that all agreements, notices, disclosures and other communications PODTech provides to you electronically, via email and on this website, satisfy any legal requirements that communications must be in writing.

CHANGES

PODTech reserves the right, at its sole discretion, to modify or replace these Terms at any time. By using this website, you are expected to review these Terms on a regular basis. Where a revision is material, PODTech will try to provide reasonable notice prior to any new terms taking effect. What constitutes a material change shall be determined at PODTech’s sole discretion.

INTERRUPTIONS AND RESTRICTIONS

PODTech may from time to time interrupt your access or your visitor’s access or use of this website to perform some maintenance or emergency services and you agree that PODTech shall not be held liable for any damage or loss which may arise thereof.

PODTech reserves the right to, at its sole discretion, terminate your access to this website and the related Service or any part thereof at any time, for any reason and without notice.
